Terms of Service

These terms are an agreement between you and BrainFever Media ("we", "us") covering the Sky Studio application for macOS and the services it connects to (together, "Sky Studio"). By downloading or using Sky Studio you agree to them. If you don't agree, don't use Sky Studio.

1. What Sky Studio does

Sky Studio replaces the sky in photographs you provide. Sky detection and previews run on your Mac. Finished renders are produced by sending your photo and a sky image to an artificial-intelligence image model operated by a third-party provider. Results vary with the input; we don't guarantee any particular outcome.

2. Your copy of Sky Studio

Sky Studio doesn't require you to create an account. When first used, the app creates an anonymous identifier tied to your Mac. Purchases and credits are associated with that identifier. If you erase the app's data, reinstall macOS, or move to a different Mac, credits may not carry over. Contact support with your purchase receipt and we'll help.

3. Credits, subscriptions, and payment

• Credits. Renders are paid for with credits. A 0.5K or 1K render uses 1 credit, 2K uses 2, and 4K uses 3. We may change these amounts for future renders with notice in the app.
• Free credits. New installations receive a small number of free credits. They have no cash value and may be limited to one grant per person.
• Sky Studio Pro. A monthly subscription that provides 100 credits each billing cycle. Subscription credits expire at the end of the cycle they were granted in and don't carry over. It renews automatically until cancelled. Cancel from Settings → Account → Manage Subscription; cancellation stops future charges, and remaining subscription credits stay usable until the current cycle ends.
• Credit packs. One-time purchases of credits that do not expire.
• Failed renders. If a render fails, its credits are returned to your balance automatically.
• Payment. Payments are processed by Stripe, with subscription management by RevenueCat. Prices are shown in US dollars and may exclude tax where tax is added at checkout. Prices may change; changes to subscription prices take effect at the next renewal after notice.
• Refunds. Credits that have been used are not refundable. For unused purchases, contact support within 14 days of purchase. Where law requires a refund, we'll provide one.
• No transfers. Credits can't be transferred, sold, or exchanged for cash.

4. Your photos and the results

You keep all rights to the photos you bring to Sky Studio. You confirm that you have the right to use and modify them. Sky images in the library are licensed to you for use within renders you create; you may not extract or redistribute them separately.

To the extent we hold any rights in a render produced from your photo, we assign them to you. You may use renders for any purpose, including commercial work. The legal status of AI-assisted images is still developing in some jurisdictions and we can't guarantee that renders are eligible for copyright protection.

5. Acceptable use

Don't use Sky Studio to create content that is unlawful, that infringes someone else's rights, or that depicts real people in a misleading way intended to deceive. Don't attempt to reverse-engineer the service, extract the sky library, or interfere with the credit system. We may suspend access for misuse.

6. Third-party services

Sky Studio depends on services we don't control, including AI model providers, Firebase, RevenueCat, and Stripe. Their availability affects ours. Their terms apply to their handling of your data as described in our privacy policy.

7. Updates and changes

We may update Sky Studio, change the sky library, adjust credit costs, or discontinue features. We may change these terms; the "last updated" date above will change and material changes will be noted in the app. Continued use after a change means you accept it.

8. Disclaimer of warranties

Sky Studio is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that renders will be accurate, that the service will be uninterrupted, or that errors will be corrected.

9. Limitation of liability

To the extent permitted by law, BrainFever Media will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business, arising from your use of Sky Studio. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.

10. Governing law

These terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Ohio, and you consent to their jurisdiction.
